Legal Agreement

Terms of Service

Last Updated: September 2026. Please review these Terms of Service carefully before purchasing an advertising spot, uploading creative assets, or using the Direct Mail Buzz platform.

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between Direct Mail Buzz Inc. (“Direct Mail Buzz”, “we”, “us”, or “our”) and the business entity or individual (“Advertiser”, “you”, or “your”) accessing our website, reserving advertising spots, or utilizing our self-serve Advertiser Studio.

By registering an account, reserving a postcard spot, submitting ad artwork, or processing a payment, you represent that you have the legal authority to bind your organization and agree to abide by these Terms.

2. The Direct Mail Buzz Service

Direct Mail Buzz provides a shared physical distribution platform for mobile applications, web platforms, and digital brands. Each scheduled “App Drop” consists of an oversized 9"x12" jumbo postcard printed on heavy 16pt UV gloss cardstock featuring up to 16 curated non-competing app placements (8 on front, 8 on back).

Drops are physically delivered to 10,000+ targeted residential households per campaign via the United States Postal Service (USPS) Every Door Direct Mail® (EDDM®) carrier routes.

3. Spot Reservations & Payment

Advertising spots are sold on a guaranteed flat-rate basis ($1,000 per spot, unless modified by an authorized promotional coupon or custom agreement). Direct Mail Buzz does not operate bidding wars or auction models.

Instant Stripe Checkout

Payments are processed securely via Stripe. Upon successful transaction authorization, your chosen spot (Spot 1–16, Front or Back) is immediately reserved in your name.

Category Exclusivity Guarantee

We guarantee 100% app category exclusivity per postcard drop. Once your spot and category are locked, no competing application in your category will be allowed on that postcard drop.

4. Creative Guidelines & Pre-Press Proofing

Advertisers must supply print-ready artwork adhering to our commercial printing specifications:

  • Spot Dimensions: Exactly 2.8″ × 3.8″ with a 0.125″ bleed perimeter and 0.125″ safe zone.
  • Resolution & Color: Minimum 300 DPI, CMYK color space (or high-res sRGB auto-converted), in PDF, PNG, or TIFF formats up to 25MB.
  • Content Standards: Advertisers agree not to submit creative containing defamatory, fraudulent, deceptive, sexually explicit, hate speech, or infringing materials. Direct Mail Buzz reserves full editorial discretion to reject or require revisions for any creative that fails to comply.
  • Production Deadlines: Artwork must be submitted and approved prior to the drop’s published press cutoff date. Failure to provide compliant artwork before press deadlines may result in spot forfeiture without refund.

5. Dynamic QR Tracking & Telemetry

Direct Mail Buzz provides a built-in dynamic QR code generator and redirection engine for your ad:

  • Dynamic Destination Routing: Advertisers can update their destination URL (website, App Store, Google Play) at any time inside the Advertiser Studio, even after cards have been printed and mailed.
  • Destination URL Compliance: You warrant that your destination URL leads to an active, secure (HTTPS) site or official app store listing free of malicious scripts, deceptive downloads, or phishing traps.
  • Attribution Data: Telemetry metrics (scans, unique households, OS distribution) are provided for analytical purposes. Direct Mail Buzz is not responsible for external app store server outages or destination website downtime.

6. USPS Delivery & Force Majeure

Postcards are inducted directly into the USPS postal stream via Every Door Direct Mail (EDDM). Direct Mail Buzz will provide official USPS postal documentation and induction receipts verifying delivery into the designated carrier routes.

Direct Mail Buzz is not liable for postal delivery delays or disruptions caused by acts of God, severe weather emergencies, postal labor actions, national emergencies, or circumstances beyond our reasonable operational control.

7. Cancellation & Refund Policy

Because each spot represents an exclusive category lock and commercial print runs involve custom batch pre-press setup, all spot purchases are non-refundable once payment is completed and category exclusivity has been secured.

If Direct Mail Buzz reschedules a drop date due to printer or postal requirements, your reservation, category lock, and artwork approval will automatically roll over to the revised drop schedule with no additional fees.

8. Intellectual Property & Trademarks

You retain all right, title, and interest (including intellectual property rights) in the creative artwork, logos, and trademarks you submit. You grant Direct Mail Buzz a worldwide, non-exclusive, royalty-free license to print, distribute, and display your creative as part of the scheduled drop and in marketing materials showcasing platform portfolio work.

“Direct Mail Buzz”, “App Drop”, and our associated branding are trademarks of Direct Mail Buzz Inc. Every Door Direct Mail® and EDDM® are registered trademarks of the United States Postal Service.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Direct Mail Buzz, its officers, directors, or partners be liable for indirect, incidental, consequential, special, or punitive damages (including loss of profits, app downloads, or business opportunities).

Our aggregate liability arising out of or related to any App Drop shall not exceed the total amount paid by the advertiser for the specific spot giving rise to the claim.
